    Bill Summary

    This bill creates the office of the repealer within the office of the secretary of state for a period of four years, at which time such position will cease to exist.

    This bill authorizes the office of the repealer to:

    (1) Receive suggestions to modify or repeal statutes and rules and regulations from citizens and government departments and agencies; and
    (2) Gather information from various sources including government departments and agencies regarding laws and rules and regulations necessary to performing the repealer's duties.

    The duties of the office of the repealer include:

    (1) Investigating and collecting information regarding the state's laws and rules and regulations to determine instances in which such laws and rules and regulations are unreasonable, unduly burdensome, duplicative, contradictory or unnecessary;
    (2) Establishing an online system to receive public recommendations regarding various laws and rules and regulations that may need to be repealed or updated;
    (3) Making recommendations to the general assembly on laws that may need to be repealed or modified with specific details as to why the law needs to be repealed or modified;
    (4) Making recommendations to the appropriate state department or agency on rules and regulations that may need to be repealed or modified with specific details as to why the rules and regulations need to be repealed or modified;
    (5) Providing a quarterly update to the secretary of state, the speaker of the senate and the speaker of the house of representatives of the repealer's activities; and
    (6) Providing a report by December 31 of each year to the secretary of state, each member of the general assembly, the governor and the heads of affected state departments or agencies of the repealer's activities, findings and recommendations.

    ON MARCH 28, 2013, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 595, AS AMENDED.

    AMENDMENT #1 adds the government operations committee of each house to the entities to whom the office of repealer will make recommendations regarding rules and regulations that need to be repealed or modified and provide quarterly updates.

    ON APRIL 15, 2013, THE HOUSE SUBSTITUTED SENATE BILL 595 FOR HOUSE BILL 500, ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 595, AS AMENDED.

    AMENDMENT #1 rewrites this bill to create the office of the repealer as a joint entity of the senate and the house and to administratively attach such office to the office of legal services. The director of legal services will serve as the director of the office of the repealer, and staff services will be performed by office of legal services staff. This amendment rewrites the duties of the office of the repealer to be as follows:

    (1) Solicit and receive suggestions and supporting information concerning state statutes or uncodified public acts that may be anachronistic, obsolete, defective, duplicative, contradictory, unnecessary or incomprehensible;
    (2) Review and evaluate systematically such suggestions and supporting information;
    (3) Identify specific state statutes or uncodified public acts that may, in fact, be anachronistic, obsolete, defective, duplicative, contradictory, unnecessary or incomprehensible and that may, therefore, be appropriate for legislative consideration of repeal, modification or revision; and
    (4) Report findings and recommendations annually, on or before December 1, to the speaker of the senate and the speaker of the house of representatives.

    In consultation with the director of legislative information systems, the director of the office of the repealer will establish an online capability to solicit and receive suggestions and supporting information.
