Education, Higher - As introduced, prohibits operation and maintenance of a campus police force by an institution of higher education that otherwise has statutory authority to operate a campus police force, if the institution requires a student organization to allow any student enrolled at the institution to participate in the organization regardless of the student's beliefs or status. - Amends TCA Title 49.

    Other Fiscal Impact - To the extent any private college or university, that operates a campus police force, elects not to adopt the policies required in this bill, the recurring increases in local government revenue and expenditures are reasonably estimated to exceed $10,000 and $100,000* respectively. Any such recurring increase in local government expenditures is considered mandatory because such costs will be imposed on the applicable local government entity based on the election decision of the private college or university. Otherwise, any fiscal impact to state or local government is considered not significant.


    Bill Summary

    Present law authorizes the board of regents of the state university and community college system and the board of trustees of the University of Tennessee to establish policies pursuant to which a suitable number of persons may be employed or commissioned, or both, as police officers, public safety officers and security officers by institutions and schools governed by the respective boards.

    This bill specifies that such authority may only be exercised and maintained by those institutions that meet all present law requirements and that:

    (1) Do not discriminate against or deny recognition to a student organization, or deny to a student organization access to programs, opportunities, channels of communication or facilities otherwise available to any other student organization on the basis of:
    (A) The religious content of the organization's speech; or
    (B) The organization's exercise of its rights described in (2); and
    (2) Do not prohibit a religious student organization from determining that the organization's religious mission requires that only persons professing the faith of the group and comporting themselves in conformity with it qualify to serve as members in good standing or leaders.
