    Bill Summary

    Generally, the federal Patient Protection and Affordable Care Act authorizes the secretary of health and human services to penalize states that choose not to participate in the expansion of Medicaid (the Tennessee Medicaid program is referred to as TennCare) provided by the Act by taking away their existing Medicaid funding. The United States Supreme Court in National Federation of Independent Business v. Sebelius ruled that such penalty was unconstitutional.

    This bill prohibits the state from establishing, facilitating, implementing, or participating in any new expansion of Medicaid (TennCare) pursuant to the federal Patient Protection and Affordable Care Act. The state is prohibited from amending the state plan or any federal waiver under title XIX of the federal Social Security Act in order to effectuate any such expansion of the TennCare program in this state.

    ON FEBRUARY 24, 2014, THE HOUSE ADOPTED AMENDMENT #2 AND PASSED HOUSE BILL 937 AS AMENDED.

    AMENDMENT #2 rewrites this bill to prohibit the governor from making any decision or obligating the state in any way with regard to the expansion of optional enrollment in the medical assistance program, pursuant to the Patient Protection and Affordable Care Act, unless authorized by joint resolution of the general assembly.

    ON MARCH 6, 2014, THE SENATE SUBSTITUTED HOUSE BILL 937 FOR SENATE BILL 804, ADOPTED AMENDMENT #8, AND PASSED HOUSE BILL 937, AS AMENDED.

    AMENDMENT #8 requires that, in event that the governor calls a special session of the general assembly to approve a joint resolution authorizing the expansion of medical assistance pursuant to this bill, then members of the general assembly will not receive or be entitled to any compensation or reimbursement for expenses, under any provision of law, for attending the special session.
