    Other Fiscal Impact - To the extent any referendum is held in conjunction with regularly-scheduled elections, any increase in local government expenditures is considered not significant. However, if a special referendum is required, the mandatory increase in local government expenditures is reasonably estimated to exceed $8,000. Due to several unknown factors, any change in local government property tax revenue cannot be quantified.


    Bill Summary

    This bill requires that the annexation of territory by a municipality be subject to approval by a majority of the persons residing in the territory that will be annexed, as described below.

    Generally, under present law, a municipality may extend its corporate limits by annexation of adjoining territories, by ordinance, when petitioned by a majority of the residents and property owners of the affected territory, or upon its own initiative when it appears that the prosperity of the municipality and territory will be materially retarded and the safety and welfare of the inhabitants and property endangered. The ordinance may not become operative until 30 days after final passage thereof. During this 30-day period, the municipality must notify the county mayor in whose county the territory being annexed is located that such territory is being annexed by the municipality.

    However, in Knox County, if the proposal to extend the corporate limits by the annexation of adjoining territory is proposed by the municipality upon its own initiative by ordinance, then the ordinance may not become operative until an election is held at the expense of the proposing municipality for approval or disapproval of such annexation by the qualified voters who reside in the territory proposed for annexation. The county election commission must hold such an election between 45 and 60 days after the receipt of a certified copy of such ordinance, and a majority vote of those voting in the election will determine whether the ordinance is to be operative. If the vote is for the ordinance, the ordinance becomes operative 30 days after the date that the county election commission makes its official canvass of the election returns, except that such ordinance may not become operative before the expiration of 120 days following the final passage of the annexation ordinance.

    This bill revises when annexation ordinances would become operative. This bill specifies that the ordinance would not become operative "until approval of such annexation by a majority of qualified voters who reside in the territory proposed for annexation," instead of "until 30 days after final passage thereof." Additionally, this bill specifies that the provisions described above regarding Knox County would apply throughout the state when the annexation is proposed by the municipality upon its own initiative.

    ON APRIL 15, 2013, THE SENATE ADOPTED AMENDMENTS #1, #4, AND #6 AND RESET SENATE BILL 279, AS AMENDED.

    AMENDMENT #1 rewrites the bill to require that the Tennessee advisory commission on intergovernmental relations (TACIR) complete a comprehensive review and evaluation of the efficacy of state policies set forth in present law regarding the change of municipal boundaries and comprehensive growth plans by January 12, 2015, and submit a written report of findings and recommendations, including any proposed legislation, to the speakers of each house. From April 1, 2013 through June 30, 2015, no municipality may extend its corporate limits by means of annexation by ordinance upon the municipality's own initiative and no such annexation ordinance may become operative during such period.

    AMENDMENT #4 exempts Cocke, Green, Hamblen and Sevier Counties from the moratorium on annexation described in the Summary for Senate Amendment #1.

    AMENDMENT #6 exempts Davidson County from the moratorium on annexation described in the Summary for Senate Amendment #1.

    ON APRIL 17, 2013, THE SENATE FURTHER CONSIDERED SENATE BILL 279, AS AMENDED, ADOPTED AMENDMENT #13, AND PASSED SENATE BILL 279, AS AMENDED BY AMENDMENTS #1, #4, #6, AND #13.

    AMENDMENT #13 rewrites this bill to establish a moratorium against any municipality extending its corporate limits by means of annexation by ordinance upon the municipality's own initiative from April 1, 2013, through May 1, 2014, in order to annex territory being used primarily for residential or agricultural purposes; and, except as otherwise permitted in this amendment, prohibits any such ordinance to annex such territory from become operative during such period.

    The moratorium against annexation on a municipality's own initiative will not apply in any county having a metropolitan form of government.

    If, prior to April 1, 2013, a municipality formally initiated an annexation ordinance delayed by this amendment; and if the municipality would suffer substantial and demonstrable financial injury if such ordinance does not become operative prior to May 1, 2014; then, upon petition by the municipality, this amendment authorizes the legislative body for the county where such municipality is located to, by a two-thirds vote, waive the moratorium.

    This amendment requires the Tennessee advisory commission on intergovernmental relations (TACIR) to complete a comprehensive review and evaluation of the efficacy of state policies set forth in present law regarding the change of municipal boundaries and comprehensive growth plans by January 14, 2014, and submit a written report of findings and recommendations, including any proposed legislation, to the speakers of each house.
