House Bill 94 is in the House Economic Development/Banking/Insurance & Commerce as of 1/28/21. This bill will adjust the minimum wage for employees receiving tips or gratuities from the flat rate of $2.23/hour to a rate of 65% of the state minimum wage.
Many tipped workers are employed by small, family-owned business who will be faced with a costly burden as a result of HB 94. The Delaware restaurant industry has been crippled by the pandemic and cannot afford to pay staff a higher base rate, especially when they have already laid off many workers in the past 10 months. This bill will lead to increased lay-offs and automation.
