    Bill Summary

    This bill exempts an individual from paying out-of-state tuition at a state institution of higher education if the individual:

    (1) Attended school in this state for the three years immediately prior to graduation from high school;
    (2) Graduated from a Tennessee high school, obtained a GED or HISET credential award by a state-approved institution or organization, or completed high school in a Tennessee home school program;
    (3) Is registered as an entering student or is enrolled at a state institution of higher education;
    (4) Has been a Tennessee resident for at least one year immediately preceding the date of enrollment in a state institution of higher education; and
    (5) If necessary, files an affidavit with the state institution of higher education stating that the individual has filed an application to legalize the individual's immigration status or will file an application as soon as the individual is eligible to do so.

    This bill will not apply to international students and nonimmigrant trainees.

    This bill authorizes the board of regents and the University of Tennessee board of trustees to promulgate rules to effectuate the purposes of this bill. This bill will apply to the 2015-2016 academic year and academic years thereafter.

    ON APRIL 16, 2015, THE SENATE ADOPTED AMENDMENT #4 AND PASSED SENATE BILL 612, AS AMENDED.

    AMENDMENT #1 rewrites the bill and specifies that a student may be classified as a Tennessee resident and will be charged in-state tuition, if the student:

    (1) Is lawfully present in the United States; and
    (2) Graduated from a Tennessee high school, obtained a GED or HiSET credential awarded by a state-approved institution, or completed high school in a Tennessee home school program.

    This amendment also exempts the extension of in-state tuition that this amendment provides from the definition of "state or local public benefit" under the "Eligibility Verification for Entitlements Act."
