Immigration - As enacted, prohibits any official or employee of this state or any political subdivision of this state from accepting an identification document issued or created by any person, organization, county, city, or other local authority, except where expressly authorized to be used for identification purposes by the general assembly to determine a person's identity or residency unless required by federal law; prohibits any local government or law enforcement agency from authorizing the use of any such card or document as a form of identification to be used to determine the identity or residency of any person. - Amends TCA Title 2; Title 5; Title 6; Title 7; Title 8 and Title 55.

    ON APRIL 12, 2018, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2312, AS AMENDED.

    AMENDMENT #1 revises the documents that cannot be accepted to be a consular card and an identification document issued or created by any person, organization, county, city, or other local authority, except where expressly authorized to be used for identification purposes by the general assembly, but provides that those will be accepted if required by federal law. This amendment adds that this bill's provisions regarding documents to determine a person's identity or residence do not apply to local education agencies for purposes of student enrollment.

    ON APRIL 24, 2018, THE SENATE SUBSTITUTED HOUSE BILL 2312 FOR SENATE BILL 2333, ADOPTED AMENDMENT #1, AND RESET HOUSE BILL 2312, AS AMENDED.

    AMENDMENT #1 substitutes "matricula consular card" for a consular identification card or similar document in reference to types of documents that this bill prohibits state and local government officials and employees from accepting for proof of identity or residence.

    ON APRIL 25, 2018, THE SENATE FURTHER CONSIDERED HOUSE BILL 2312, ADOPTED AMENDMENT #7, AND PASSED HOUSE BILL 2312, AS AMENDED BY AMENDMENTS #1 AND 7.

    AMENDMENT #7 rewrites this bill to prohibit any official or employee of this state or any political subdivision of this state shall from accepting an identification document issued or created by any person, organization, county, city, or other local authority, except where expressly authorized to be used for identification purposes by the general assembly to determine a person's identity or residency unless required by federal law. This amendment prohibits any local government or law enforcement agency from authorizing, by policy, resolution, or ordinance, the use of any such card or document as a form of identification to be used to determine the identity or residency of any person. Any local government or law enforcement policy, resolution, or ordinance that conflicts with this amendment will be unenforceable and must be repealed or rescinded by the appropriate authority. This amendment does not apply to:
    (1) Student identification cards; or
    (2) Private or public employee identification cards issued in the normal course of business or for internal purposes.
