    Bill Summary

    Present law requires the department of health to implement public education programs to inform persons of genetic screening, genetic disorders, and birth defects and the various services available. Present law also requires the department to disseminate information about the birth defects registry that the department maintains to the participating perinatal centers that will be made available to the family, that explains and describes the purpose and process of the registry and how confidentiality will be protected.

    This bill requires that the information described above be provided in pamphlet form that will be provided to the family to review and sign an acknowledgment of receiving the information about newborn testing before any blood sample for testing is drawn from the newborn. The pamphlet must disclose the exemption from testing or treatment of a child based on religious beliefs. The pamphlet must also inform the family of the newborn screening specimen use, retention, and disposal policy that this bill will implement.

    This bill requires that a newborn screening specimen taken for testing the presence of metabolic or genetic defects shall be kept for one year to permit time for the infant's physician to request additional tests. The specimen and the form containing the identifying information shall be kept separate. After one year, both the specimen and the form shall be destroyed. If a specimen is needed for quality assessment, quality control, or test calibration, that specimen may be retained for longer than one year; provided, that the form containing the identifying information has been separated from the sample and destroyed, to ensure that the source of the sample cannot be identified.

    This bill authorizes the department to exhaust its existing stock of pamphlets before printing new pamphlets that meet this bill's requirements.

    Under present law, a violation of the laws concerning disease prevention by any person is generally a Class C misdemeanor. This bill makes the criminal offense applicable to violations by any healthcare provider rather than any person.

    ON APRIL 8, 2015, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 674, AS AMENDED.

    AMENDMENT #1 removes the requirement that the family review and sign an acknowledgement of receiving the information, and the requirement that the specimen and form containing identifying information be kept separate. This amendment clarifies that the form containing identifying information will be destroyed after one year. This bill removes the provision of the bill, described above in the bill summary, that would have made the criminal offense only applicable to a healthcare provider instead of any person.
