Today we received positive news that Senator Liz Brown offered an amendment to HB 1115 to revise language that would entirely remove the ability of an Association or management company to charge for a payoff letter, and which revises other harmful language restricting homeowner service fees. Amendment #3 restores the ability for associations to charge a $50 fee when preparing a statement of unpaid assessments for a resale or refinance. It would reinstate authority for associations to collect other service fees - a provision that had been removed in earlier proposals.
Senator Brown’s amendment will preserve transparency and will prevent what are now visible, one-time, consumer-facing service fees from being passed on to all homeowners.
