Section 401 has historically given state and tribal governments the authority to challenge large energy projects with long-term impacts on water quality, like oil and gas pipelines. But under the new rule, states and tribes would only be able to consider the immediate water quality impacts of a project when choosing to approve or reject it, regardless of long-term impacts.
