EPA failed to correctly interpret changes to the Energy Information Administration’s reports on volumes of biodiesel, renewable diesel and petroleum distillate. As a result, EPA adjusted the volumes of gasoline and diesel it uses to calculate annual RVOs and provided no opportunity for public comment. EPA’s adjustments undercut the percentage volumes for all obligations in the RFS program for 2023 – 2025.
EPA also recently denied more than two dozen pending small refinery exemptions, providing some additional transparency on the refineries requesting the exemptions. This is a welcome move after the agency eased compliance requirements from past exemptions. Nevertheless, congressional allies of the small refineries are proposing to provide new exemptions and additional relief to certain refineries – which will come at a cost to the biodiesel industry.
Please write to your Representative and Senators to warn against accepting any deal on small refinery exemptions.
And please send a letter to EPA Administrator Michael Regan encouraging him to meet with Clean Fuels and learn more about the biodiesel, renewable diesel, and SAF industry.
