Comment on Proposed Rules for the 45Z Clean Fuels Production Credit

On February 4, the U.S. Treasury and IRS published proposed rules for the §45Z Clean Fuels Production Credit. Treasury is accepting comments on the proposal through April 6, 2026.
The proposal addresses comments and concerns expressed by industry on the January 10, 2025, notice of intent to propose rules for the credit. IRS clarifies issues with qualified sales, specifically allowing sales to fuel marketers as requested by producers. The proposal incorporates other suggestions and requests from industry.
The agency also intends to hold a public hearing on May 28. Requests to testify must be submitted by April 6 and must include an outline of the topics to be discussed.
