What is the Issue?
In recent years, the rules on worker classification have been on a regulatory rollercoaster, shifting with changes in political leadership. Democratic administrations tend to make it easier to reclassify independent contractors as employees, while Republican administrations favor maintaining workers’ status as independent contractors.
While the current Department of Labor (DOL) has stopped enforcing the 2024 Independent Contractor Rule, and we anticipate them reinstating the 2021 Rule, the rule could still be overturned by future administrations.
To end this constant uncertainty, Rep. Kevin Kiley (R-CA-03) has introduced the Modern Worker Empowerment Act (HR 1319), which would create a clear, consistent federal definition of employees and independent contractors to protect independent workers.
What is FSI doing on my behalf?
We are urging members of the House Committee on Education and the Workforce to support the bill, and with your help, our efforts were successful. The Committee recently voted 19-16 to advance the legislation. The next step is a vote on the full House floor.

We are looking to capitalize on the momentum of the recent committee vote and build support in the full House.
