H.R. 9771 | The Stopping Foreign Influence in Elections Act of 2026
- This bill would bar any 501( c) organization from making any contributions to a "political entity" within 2 years of receiving any donations. This bill defines political entity to include a 501(c ) 4. In order to comply, nonprofits would have to collect the citizenship of every single donor, making donors give personal information that would diminish the trust of the communities the nonprofit serves. This bill would also make it harder for nonprofits to engage in lawful advocacy.
H.R. 9721 | The Fiscal Sponsorship Transparency Act of 2026
- This bill imposes additional reporting requirements on nonprofits by requiring all nonprofits to report annually on each fiscally sponsored project, the total amount of funding provided to the fiscally sponsored project, a description of the activities for which funds were transferred, and more. This bill would create significant financial liabilities for nonprofits and managers and have imposed taxation penalities for "improper conduit arrangement". The bill also does not define the standards it lays out in the text language, and how nonprofits could be held liable for incorrect arrangement if the bill were to become law.
H.R. 9772 | The Foreign Funding Transparency Act
- This bill would impose additional reporting requirements on certain 501(c ) organizations that receive donations from a foreign national, and bar certain government entities from collecting or disclosing donor information. Nonprofits already report the names and addresses to the IRS on a confidential basis. if this bill were to be enacted, nonprofits would have to publicly report the information and nationality of its donors. Again, nonprofits could risk losing the trust of their current donors and their communities if they are required to collect and then report this information.
Forefront is opposed to all three pieces of legislation as they force nonprofits to disclose sensitive information about their donors (even small dollar donations), and report the required information to the federal government. Charitable giving is already decreasing nationally, and these bills would make it more challenging for nonprofits to meet their missions. Additionally, the lack of terms defined in some of the language makes it unclear what standards nonprofits would be held to if these bills were to pass and be enacted, as well as unknown penalties and consequences on our sector.
