H.R. 5601, known as the Marijuana Opportunity Reinvestment and Expungement Act, will remove marijuana from the Controlled Substances Act, thereby decontrolling and decriminalizing it. Marijuana has been a Schedule 1 drug since 1970. It has no current acceptable medical use and has a high potential for abuse. H.R. 5601 will also allow certain convictions to be expunged from criminal records.
S. 2860, known as the SAFER Banking Act, has been passed in the House on several occasions, only to be stalled in the U.S. Senate. S. 2860 removes the part of federal statute that prohibited banks from providing financial services to marijuana businesses. The Senate Finance Committee approved S. 2860 on September 27th by a 14-9 vote and has sent it to the full Senate for a vote.
