This secretive process, commonly referred to as gut-and-amend legislating, is a deceitful practice that involves taking an existing piece of legislation that has largely advanced through the State Assembly, and repurposing it to cover a completely different subject altogether -- all without having to re-work its way through the proper committees or facing the typical scrutiny and debate most all bills would be subjected to before becoming law.
And that's exactly what's being done with AB 455, right now.
The original context of the bill dealt with the regulation of traffic lanes on the San Francisco-Oakland Bay Bridge -- nothing whatsoever to do with vaccine passports, nor any other Covid-related policy at all.
But it seems that may soon inexplicably change: A previously unreleased, amended version of AB 455 that was apparently drafted by its primary sponsor, Democrat Assemblywoman Buffy Hicks, was acquired and published by the California Globe just last week, and the new language appears to gut the original content regarding tolls and replace it with intrusive, coercive vaccine policies that discriminate against unvaccinated Californians.
While these changes haven't formally been introduced yet, the new AB 455, should it come up for a vote before the end of the 2021 legislative session, would immediately require private establishments to ask all people to present proof of vaccination for Covid-19 -- medical documentation -- in order to be granted entry to an indoor facility.
In other words, the new AB 455 would outright legalize vaccine passports in the state of California.
These proposed changes define "proof" of vaccination as "valid documentation of the person's COVID-19 vaccination record, which may be their vaccine card or a copy or a digital version thereof, as provided by their health care provider, the State Department of Public Health, or another state or federal agency."
Additionally, the specific establishments targeted by the bill would include inns, hotels, motels, etc.; restaurants, bars, cafeterias, lunchrooms, lunch counters, soda fountains, etc.; motion picture houses, concert halls, sports arenas, stadiums, gyms, spas; and any other "establishment that is physically located within the premises" of any other mentioned above.
To be clear: Even if these drastic changes are officially made to the legislation, AB 455 would NOT have to gain committee approval again, and would automatically go to the floor of both chambers of the State Assembly for a final vote -- with minimal time for the review and debate that is generally conducted before the approval or rejection of a bill that undergoes the entirety of the legislative process.
If this sounds crazy, that's because it is crazy.
Not only is the potential new language of AB 455 deeply unsettling and blatantly discriminatory, the process by which California lawmakers are looking to ram it through the legislative process is maddeningly deceptive and unethical -- the precise kind of thing politicians often do (and get away with) to forge ahead their agenda while heightening the mistrust between themselves and their constituents.
Put simply: Approving the new version of AB 455 would both greenlight vaccine passports and further medical coercion under state law, and legitimize the ridiculous practice of gut-and-amend legislating.
The right of ALL people to decide for themselves whether or not to get vaccinated should be respected under the law, and no Californian's ability to move freely within society should be threatened or hindered if they opt against doing so.
That's why we need YOU to take a stand for Californians' medical rights, and to voice your opposition against deception in lawmaking as an unethical means to an unconstitutional end!
Please take a few minutes to contact your State Assembly Members as soon as possible, and implore them to reject gut-and-amend legislation that would make vaccine passports a reality here in California.
