Before his nomination to the U.S. Supreme Court by Bill Clinton in 1994, Stephen Breyer was a Federal Appeals Court Judge. In the time since as an Associate Supreme Court Justice, Breyer has proven a reliably liberal vote on the court, repeatedly siding with the abortion industry and issuing opinions often at odds with a textualist philosophy of constitutional law.

Now the oldest member of the bench at 83, Breyer announced in a press conference that he is planning to step down at the end of the current term, which may well be the one that sees Roe overturned once and for all by way of Dobbs v. Jackson Women's Health Organization -- a case in which Breyer is likely to vote in favor of upholding the deadly, outdated ruling regardless of the ultimate outcome.

That said, we all know that Joe Biden will be eager to appoint a replacement very much in the vein of Breyer, and may well opt for a nominee to the left of Breyer both in terms of personal politics and judicial philosophy -- a dangerous precedent for not only the Supreme Court, itself, but for our country.

Since taking office just over a year ago, the Supreme Court has, in many instances, been the last line of defense between Biden's insatiable pursuit of authoritarian policies and the preservation of our constitutional rights in the face of unprecedented infringement on behalf of the federal government.

Just a couple weeks ago, it was the Supreme Court that ruled against the implementation of Biden's OSHA vaccination mandate, which would've required all private U.S. employers with more than 100 workers to implement their own vaccine mandate or face fines and other penalties for refusing to comply.

Likewise, it was the Supreme Court that allowed Texas's heartbeat bill (which outlaws abortions after the detection of a fetal heartbeat) to go into effect, as intended, back in September, after it was signed into law by the governor -- effectively saving approximately 85% of the babies who would've otherwise never made it.

It's because of rulings like these that it's so important to ensure that members of the Supreme Court are dedicated to upholding the law, interpreting the Constitution as written, and defending and protecting the rights of ALL Americans, from conception to death.

And remember:  Liberal members of the Senate were absolutely merciless in their personal and baseless attacks on President Trump's three nominees during each of their confirmation hearings, often completely ignoring legitimate inquiries about their past rulings and judicial philosophies in favor of despicable mudslinging. 

This unwillingness to even consider such qualified nominees is evidenced by the unprecedentedly narrow margins that Justices Gorsuch (54-45), Kavanaugh (50-48), and Barrett (52-48) were confirmed by in the Senate. But now, the ball is in conservative Senators' court, and, with our constitutional rights on the line, it's time to play hardball: They must take this opportunity to focus on what matters, and analyze any nominee's record as a judge, bringing to light any and all revelations that may suggest a lack of loyalty to our nation's founding document should that nominee ultimately be confirmed, and strongly opposing them.

While Justice Breyer's retirement is unlikely to shift the Court any further to the left (based on most recent votes, conservatively-prone Justices tend to outnumber liberally-prone Justices 6-3), the only replacement members of the U.S. Senate should vote to confirm is one who respects the Constitution, the rule of law, and the right to life.

For months, liberal activists have encouraged Breyer to retire, likely out of fear that this year will be the last chance for Biden to get a younger, even more liberal nominee approved given the 50-50 split in the Senate (in a strictly party-line vote, the tie would be broken by Vice President Kamala Harris) and the possibility that Republicans could regain the majority during this year's midterm elections, not to mention the increasing likelihood that Biden, himself, could be a one-term president.

But it doesn't matter who Biden chooses (he has already committed to nominating a black female to any potential vacancy) -- Breyer's retirement will surely be taken as an opportunity to keep the seat as liberal as possible for as long as possible, and we must reaffirm to our elected officials in Washington that we, the American people, wish to see the next Justice of the Supreme Court uphold and defend the Constitution, not manipulate it to justify the Biden Administration's radical, authoritarian agenda.

So please, take a few minutes today to contact your members of the U.S. Senate and ask them to reject any potential Biden nominee that refuses to take a strict constitutionalist approach to interpreting laws and who will not defend the rights of ALL Americans as a Supreme Court justice.
