Urge Your Senator to Co-Sponsor S. 1253
On Monday, October 28th, 2019, the House of Representatives voted to pass H.R. 3942. Its Senate companion (S. 1253) is now making its way through the Senate.

Congress passed the Prevent All Cigarette Trafficking Act (PACT Act) in 2010 to regulate online cigarette sales. However, when the PACT Act was originally introduced, e-cigarettes weren't included since they were just coming onto the market. 

As a result, there is an online loophole in which minors could get access to e-cigarettes. Now the most common retail source of e-cigarettes to minors is the Internet. 

NACS believes this online loophole should be closed, which is why we support the Preventing Online Sales of E-Cigarettes to Children Act (S. 1253). The legislation advances the policy goal of preventing underage sales and provides a fair regulatory structure for businesses. It would require the online sellers of e-cigarettes to ensure that a delivery person verifies the ID of an adult at the time of delivery. It would also require the online sellers to comply with state and local tax requirements.

The PACT Act has worked for cigarettes and we believe that it should be updated to apply to e-cigarettes. Please contact your Senators today and ask them to co-sponsor S. 1253. If your Senators are already a co-sponsor, our system will generate a "thank you" email for you to send.
