Ask Congress to Restore Integrity to the Renewable Fuel Standard
The Environmental Protection Agency continues to create uncertainty for the biodiesel industry with the Renewable Fuel Standard program. 

The agency failed to propose a 2021 RFS rule on time. Earlier this year, newspapers reported that the Biden administration is considering ways to waive the annual volume requirements in light of the impact of COVID on oil refineries. More recently, news outlets report that the Biden administration will lower biofuel volumes for 2021 -- and retroactively for 2020.

Additionally, refineries secured an important court victory that could undermine the RFS. In June 2021, the Supreme Court struck down part of an important lower court decision, saying that refineries may continue to seek extensions of small refinery exemptions each year even if they were ineligible in a prior year. The ruling gives substantial discretion to EPA to grant the exemptions. In response, refiners are filing additional exemption petitions. 

Contact your elected officials and keep them updated on these developments. Encourage them to work with EPA Administrator Regan to restore integrity to the RFS.
