Tell DOL to Rescind the Persuader Rule!
On June 12, the U.S. Department of Labor (DOL) issued a notice of proposed rulemaking (NPRM) to rescind the Obama administration's persuader rule. Please write to DOL and support efforts to roll back this anti-business regulation!
On April 15, 2016, the persuader rule went into effect; it drastically limits the "advice" exemption in regard to labor discussions between employers and their consultants. Prior to the rule's enactment, employers and any lawyers, consultants or other experts hired for labor advice were exempt from reporting their discussions to DOL as long as there was no direct communication with employees. The persuader rule narrowed this exemption so that virtually all interactions between employers and labor lawyers or consultants are now subject to disclosure.
The persuader rule makes it very difficult for attorneys to maintain client confidentiality and employers to obtain confidential and critical legal counsel on labor relations matters. The changes also make it harder for employers to train supervisors on labor issues without violating the law. All of these repercussions make it less likely employers will exercise their First Amendment right to discuss the pros and cons of unionization with employees.
In November 2016, a federal judge in Texas issued a permanent injunction against the rule, preventing it from taking effect. In the meantime, the Trump administration is looking into rescinding the rule in its entirety.
