Prop 65 Could Be Coming To New Jersey
We have seen Prop 65 in California and New York. Now, New Jersey lawmakers Assemblywoman Lisa Swain, Assemblyman Christopher Tully and Assemblywoman Valerie Vainieri Huttle are proposing similar burdensome legislation. That is why I am calling on you to let them know you stand against A-2104, New Jersey’s version of Proposition 65.

This legislation places the burden of proof solely on manufacturers to prove that a warning is not required rather than on the state government to prove that a warning label is required. This is the exact opposite of the Federal Food Drug and Cosmetic Act, which places the burden of showing something is unsafe on the government.

Incredibly, this legislation does not establish a safety line for contaminants. All this does is line the pockets of the plaintiffs' bar looking to settle for significant sums at the cost of your bottom line.

We can not let them win. Your business and the industry are at stake. Let Assemblywoman Swain, Assemblyman Tully, and Assemblywoman Vainieri Huttle know that this legislation is bad business, bad government, and bad for New Jersey.
