Bills Vetoed Last Session  
 

Governor Sandoval vetoed 41 bills last session, and 15 of those bills were vetoed after the close of session. This means that the current Legislature has the ability to override the veto on those 15 bills.

Leaders in the Legislature have indicated that they will not bring back the measures for a veto override vote at this point. However, many of the issues covered in those vetoed bills are likely to resurface this session. This includes, among others:

  • Minimum wage
  • Energy
  • Criminal justice
  • Medicaid

  Evictions  
 

SB74 would clarify the number of days to file a notice of appeal for a summary eviction as opposed to an unlawful detainer action, which is a formal civil trial. Current law only addresses the number of days to file a notice of appeal for an unlawful detainer and for summary eviction for nonpayment but does not specifically address summary evictions in non-rent evictions (nuisance, waste, non-rent lease violations). This bill seeks to set the number of days to file a notice of appeal for a summary eviction in non-rent evictions to 5.

A verified complaint of expedited relief is a complaint tenants may file if they feel that the essential services have been cut off by the landlord wrongfully without an eviction proceeding or if they feel they have been unlawfully locked out. Current law prohibits a tenant from filing a verified complaint of expeditated relief if the landlord has filed for summary eviction. This creates a problem if the tenant prevails and the eviction action is denied as the case is automatically sealed in those instances, because there is no case to tie an award of damages for the tenant. This bill would allow the courts to hear both cases at the same time and consolidate a summary eviction case with a verified complaint of expedited relief if needed but allow them to bifurcate the cases if the tenant prevails.

SB74 was heard in the Senate Judiciary Committee on February 7.
