Increase in Real Property Transfer Tax  
 

Brought forward by the City of Las Vegas, AB73 proposes a tax of $0.25/$500 of value imposed in counties with a population of 700,000 or more. This tax would be imposed at the time of transfer, i.e. real property transfer tax (RPTT). The county recorder would collect the tax and remit the proceeds to the Local Government Tax Distribution Account.

The bill would also allow cities to impose and collect an annual surcharge on users of the sewer system in an amount not to exceed $25.

Proceeds received by the county and each city through these two mechanisms must be used to provide services or affordable housing to the homeless or indigents.

The bill was referred to Assembly Taxation. No hearing has been scheduled at this time.

  Agents Responsible for Redacting Some Provisions in Recorded Documents  
 

Introduced by Senator Julia Ratti, SB117 seeks to address issues with CC&Rs that contain restrictions or prohibitions based on race, color, religion, ancestry, national origin, sexual orientation, or gender identity or expression. The bill would make those restrictions or prohibitions void instead of voidable, eliminating the need to file an affidavit with the county recorder to void such restrictions or prohibitions. It also adds disability, familial status and sex to the list of restrictions and prohibitions that are void and unenforceable.

The measure would also prohibit a county recorder from providing a copy of an original recorded document (with limited exceptions) which contains any restriction or prohibition described above unless the county recorder redacts the copy of the document to remove that language, and adds an annotation to the redacted copy to state that the document has been redacted because those sections are void and unenforceable under the law.

Subsection 9 of the bill is where the Legislative Management Team has identified a significant problem for REALTORS®. It states that if an original recorded document contains such restriction or prohibition, a title insurance company, escrow company, real estate broker, real estate agent or homeowners' association shall not provide a copy of the original document and shall instead provide a redacted and annotated copy of the original.

The bill has been referred to Senate Judiciary. It has not been scheduled for a hearing at this time.

  Rent Control?  
 

Brought forward by Senator Julia Ratti, Chair of Senate Government Affairs, SB103 is one of the measures coming out of the Interim Committee on Affordable Housing. Senator Ratti was the Chair of that committee.

As introduced, this bill would allow a local government to reduce impact fees, building permit fees, and fees for an enterprise fund (under certain circumstances).

During the hearing in Senate Government Affairs on February 11, Senator Ratti proposed an amendment that would allow local governments to pass ordinances allowing rent control and inclusionary zoning.

Your Lobbying Team testified at the hearing in support of the bill as introduced, but strongly opposed to the amendment.

  Summary Evictions Increased Timelines  
 

SB151 would significantly increase the pay or quit timeline from 5 full days to 10 judicial days. It would also increase the period of time in which the constable has to remove a tenant in default of rental payment from within 24 hours after the court order to no earlier than 48 hours.

The bill would increase the amount of time a person has after receiving a written notice to surrender when the person holds over and continues possession of real property or a mobile home that has been sold or foreclosed upon from 3 days to 30 days.

It also changes the method of service for the notices to the Nevada Rules of Civil Procedure or the Justice Court Rules of Civil Procedure.

The Legislative Management Team and the Lobbying Team will be working with legislators to explain how this would affect the rental market in the state.

SB151 has been referred to Senate Judiciary. It has not been scheduled for a hearing.
