CALL TO ACTION! Oppose Onerous Changes to Summary Evictions  
 

Senator Julia Ratti introduced SB151 on February 12, and it contains several provisions of concern for landlords and property managers. NVR is opposed to SB151.

SB151 would:

  • Increase the pay or quit timeline from 5 full days to 10 judicial days;
  • Increase the period of time in which the constable has to remove a tenant in default of rent from within 24 hours of the court order to no earlier than 48 hours;
  • Increase the amount of time a person has after receiving a written notice to surrender when the person holds over and continues possession of real property or a mobile home that has been sold or foreclosed upon from 3 days to 30 days; and,
  • Change the method of service of the notices to the Nevada Rules of Civil Procedure or the Justice Court Rules of Civil procedure, as applicable.

  HOA Restricted from Prohibiting Pet Ownership  
 

Assemblywoman Alexis Hansen introduced AB161, a bill that would restrict HOAs from prohibiting at least one pet. It would still allow an HOA to set rules that reasonably restrict the ownership of pets by a unit's owner.

Owners who have pets would be grandfathered in and able to keep the pets they had prior to the implementation of the rules. For the purposes of this bill, "pet" means any domesticated bird, cat, dog or aquatic animal kept within an aquarium or other animal as agreed upon by the association and the unit's owner.

The impetus for this bill came from the American Society for the Prevention of Cruelty to Animals (ASPCA). One of their primary goals is to keep pets and people together, and they are working to remove barriers that cause families to relinquish their pets at shelters. One of the most cited barriers is issues with housing, especially complete prohibition of pet ownership. Many of these prohibitions are imposed by landlords, but increasingly, they are seeing HOAs putting such prohibitions in place. The Humane Society of the United States echoed the ASPCA's statement on housing being the main reason for owner surrenders and expressed its support for this bill.

The measure was heard in Assembly Government Affairs on February 27.

  Nevada Democrats Blueprint  
 

Earlier this week, the Nevada Senate Democrats and the Assembly Democratic Caucus presented their "Nevada Blueprint." While the handout (available here) laid out numerous topics, Senate Majority Leader Atkinson and Speaker Frierson addressed some of their top concerns. Among those were:

  1. Healthcare
  2. Public education
  3. Update to school funding
  4. Small businesses, and
  5. Paid sick leave/earned sick leave

Specifically, Senate Majority Leader Atkinson stated the goal was to codify protections for pre-existing conditions, and Speaker Frierson mentioned that Medicaid reimbursement rate was an important component of improving healthcare in the state.

When discussing small businesses, Senate Majority Leader Atkinson said that as a small business owner himself, he is always interested to learn more about the challenges of others as well as educate his colleagues on those challenges. Both Senate Majority Leader Atkinson and Speaker Frierson agreed that surrounding states are addressing the situation of an increase in minimum wage and that it is time that Nevada does so as well.
