Deadline and Next Steps  
 

Only 18 bills failed to meet the April 23 First House Passage deadline. Thankfully, SB230, which makes changes to real estate licensing to improve the professionalism in the industry, did make it out of the Senate unanimously and now moves on to the Assembly. AB335, the HOA resale package bill made it out of the Assembly unanimously as well, and is now going to the Senate.

Unfortunately, both SB151 (final vote Yeas: 13, Nays: 8) and SB256 (final vote Yeas: 11, Nays: 10) made it out of the Senate as well. Both bills deal with landlord-tenant issues, with SB256 being the most eggregious of the two. Please watch for a potential call to action to the Assembly now that those measures move on to the Assembly.

On May 1, we will be on the lookout for the Economic Forum report, which is an update of the revenue projections that were used by the Governor to present his budget. The rumors we are hearing these days indicate that the projected revenues might be less than originally anticipated. That means budgets will need to be adjusted accordingly - tough choices await our elected officials as we near the end of session.

  Allowing Local Governments to Impose Rent Control and Inclusionary Zoning  
 

SB398 is another measure intended to address affordable housing across the state. It does not specifically mention rent control or inclusionary zoning, but the section of concern is where it would add to the definition of "matters of local concern" in the section of NRS commonly referred to as "Dillon's Rule," which dictates that the local governments only have the powers specifically allowed by the state government. By adding "the development or redevelopment of affordable housing in the city or any action taken by the local government to ensure the availability or affordability of housing," it essentially gives the ability for a local government to implement measures like rent control and inclusionary zoning.

It passed out of the Senate on a 15-6 vote and now heads to the Assembly.

  Recording the Striking of Discriminatory and Void Provisions in CC&Rs  
 

SB117, which we discussed back in February and March, has evolved significantly since it was introduced. In its original form, it would have made real estate agents (among others) responsible to redact and annotate recorded documents if they contained discriminatory language.

Thanks to your Lobbying Team, it was amended in Senate Judiciary so that now the bill simply would create a form, similar to that of the homestead declaration, that a homeowner could fill out and record to remove a discriminatory restriction from a recorded CC&R.

It was heard in Assembly Judiciary on April 26, and your Lobbying Team testified in support of the first reprint of SB117.
