Session Almost Over, Emergency Measure Expected  
 

THREE DAYS. Sine Die is Monday, June 3, no later than midnight. Not that we're counting... Days are long in Carson City (think until 11 pm or midnight all week), and there will be meetings and floor sessions throughout the weekend. There has been a lot of committee meetings scheduled at the "call of chair" (which means your Lobbying Team is in the building to keep an eye on everything), as well as long floor sessions interrupted by behind the bar committee meetings. Behind the bar meetings usually happen like this: the chair of the committee asks the presiding officer for a recess to have a committee meeting. They then gather behind the bar on the floor and discuss certain bills and vote on them. When they adjourn, they go back on the floor and present the committee report, and then those bills can be considered by the full body. A bill can move VERY quickly, and there are no public interaction during those behind the bar meetings. Again, your Lobbying Team is in the room during every floor session to monitor those meetings as well as the votes of the full body.

We are hearing that an emergency measure will be introduced that would allow for the cities or counties to go to a vote of the people to raise property taxes up to 0.05% for public safety. It would authorize certain city councils to put a property tax on the 2020 ballot only, capped at 0.05% (one twentieth of a percent; $65 on a $372,000 home), dedicated to public safety. We have not seen the language yet, we are waiting for the introduction to bring to your Legislative Management Team to assess its potential impact on real estate.

Two priority bills for NVR have cleared the hurdles so far, one awaiting the Governor's signature and the other has been signed into law:

  • SB230, which would make various changes to real estate licensing (Advocate: 5/24, 5/17, 5/3, 4/26, 4/19, 3/29, 3/15, 2/22), has been delivered to the Governor. It would become effective January 1, 2020, for the pre-licensing requirements, and July 1, 2019, for the purpose of adopting regulations for the other provisions of the bill.
  • AB335, which makes changes to HOA fees and resale packages (Advocate: 5/245/17, 5/10, 4/26, 4/5, 3/22), was signed by the Governor on May 25. Some sections of the bill are effective on May 25 (10 calendar days vs. 10 days; resale package good for 90 days; allow HOAs to provide a statement of demand to seller and prospective buyer), others on January 1, 2020.

  Independent Contractor Status at Risk  
 

SB493, which would create the Task Force on Employee Misclassification, had a proposed amendment that threaten your independent contractor status (Advocate: 5/244/12). It passed out of Senate Finance on May 30, and your Lobbying Team was able to ensure the provisions of this bill only applied to contractors licensed under NRS 624 (i.e. not REALTORS®!). It would be effective July 1, 2019.
