The Climate Superfund Act, also known as the Polluters Pay Act, seeks to retroactively penalize New Jersey companies $50 billion for legally providing fossil fuels that were and are essential to our survival, prosperity and national security. 

The retroactive penalties of these companies, which are likely unconstitutional, WILL result in higher prices at the gas pump and higher utility bills to add to New Jersey’s well-documented energy affordability crisis. 

Applying a cost analysis performed by the U.S. Chamber of Commerce, this bill will amount to a $14,000 tax increase per New Jersey household over the course of the next 20 years.

Further, it will also destroy good, family-providing jobs from our two remaining New Jersey refineries.

It will also exacerbate New Jersey's terrible business climate and set a new precedent that tells all New Jersey employers, regardless of industry: Follow every rule, law and permit, you can still be retroactively penalized tens of billions of dollars.

The bill would have no bearing on climate change and will result in millions of additional legal costs for New Jersey, as states do not have authority to impose liability for global atmospheric conditions under the federal Clean Air Act.
