Delay the ABC Test Restricting Independent Contractors in NJ!

Despite widespread opposition from freelance workers, the business community and New Jersey lawmakers from both sides of the political aisle, the Sherrill administration is adopting new rules that make sweeping changes to the ABC test that determines whether a person is a freelancer or an employee.

The result of which WILL be the following by Oct. 1:

  • It WILL be much more difficult to be an independent contractor in New Jersey.
  • It WILL reduce the flexibility and entrepreneurship that freelancers seek and, in many cases, need to earn a living.
  • It WILL add great costs and burdens to business.

With so much at stake and with a failed history of the same policy in California, we are respectfully asking the Sherrill administration to delay the implementation of the Oct. 1 effective date until July 1, 2027.

This will provide additional and sufficient time to address the many unresolved issues within the ABC test before businesses and independent contractors are required to comply.

Take just a moment to tell the Sherrill administration and state lawmakers to pause the flawed ABC test to protect freelance workers and businesses that use them.
