SB190 would give parental rights the same legal protection as we currently have for freedom of religion and freedom of speech. Only 11 states are missing these protections - South Dakota is one of them.
The legislation does multiple things:
• Clarifies that we will apply "strict scrutiny” to government actions that infringe on a parent’s rights (like we do for religious practice, or freedom of speech)
• Clarifies that a parent has the responsibility for the upbringing and care of their child
• Clarifies that the rights of a parent do not in any way give permission for abuse or neglect
20+ states cross the nation have similar language to SB190, asserting that parental right are fundamental
32 States have clear laws or court rulings asserting that parents have “strict scrutiny” protection against government infringement
South Dakota has neither of these
