The United Chamber Advocacy Network and our coalition Chamber members OPPOSE AB 2564 (Ward) because it prevents retail businesses (including Chambers) from offering customer specific pricing including discounts, uses ambiguous and undefined terms that create liability exposure related to compliance, and allows for frivolous litigation by private citizens against our community businesses.
For context, AB 2564 would prevent a retail business from offering (including but not limited to):
While we appreciate and support the intention of this bill — to ensure California consumers are treated fairly and without discrimination — we are very concerned by the collateral damage that its broad language will have for California retailers as they attempt to compete and offer discounts for consumers. For these reasons, we must OPPOSE AB 2564 (Ward) and ask you to send a communication using this Action Alert to your State Legislator.
