Thank President Trump for Restoring Confidence in the Renewable Fuel Standard
On September 14, 2020, EPA rejected 54 pending retroactive small refinery exemption petitions, some dating all the way back to 2011. 

The petitions sought to dismantle a January 2020 decision by the U.S. Court of Appeals for the 10th Circuit. The 10th Circuit found EPA exceeded its authority in granting small refinery exemptions in 2016 and 2017, especially where EPA cited factors other than the RFS when granting the hardship waivers. The Court said that EPA could only extend temporary exemptions that had been granted in 2012. In response, the refiners filed "gap-filling" exemption petitions to try to create continuous yearly exemptions. 

EPA is still considering a handful of these retroactive or "gap-filling" petitions as well as additional petitions for the 2019 and 2020 compliance years. And refiners have appealed the 10th Circuit decision to the Supreme Court.
