Ask Legislators to Continue Support for the RFS
The Environmental Protection Agency estimated small refinery exemptions when setting the annual RFS volumes beginning in 2020, which will help to limit future damage to the biofuel industry. Congress has proposed two bills -- the Renewable Fuel Standard Integrity Act of 2019 (HR 3006) and the Small Refinery Exemption Fairness Act of 2019 (HR 4385) -- that will direct EPA to properly account for demand destruction from the waivers.

In January, the U.S. Court of Appeals for the 10th Circuit ruled that EPA's use of small refinery exemptions were turning the program on its head. The ruling could block EPA from handing out future small refinery exemptions. Nevertheless, EPA is not proposing to make up the 4 billion gallons of renewable fuel demand destroyed by small refinery exemptions for 2016-2019. 

Use the form on the right to send a message to your Representative and Senators and ask them to support the RFS. Ask them to oppose legislative attempts -- in appropriations language and other bills -- that expands EPA's use of small refinery exemptions. And let them know that the industry does not support the GREENER Fuels Act (HR 5113) because it will undercut the biodiesel industry.
