Please Support HB1541 - Anti-Indemnity in Construction Contracts
House Bill 1541, introduced by Representatives Joe Hohenstein (D-Phila) and Marla Brown (R-Lawrence) needs your strong support. After years of negotiations and numerous drafts, the sponsors have achieved agreed upon language with several stakeholders and the bill was amended and reported from the PA House Judiciary Committee on February 4.  It now awaits consideration by the full House this spring. 

This important piece of legislation will prohibit certain indemnification agreements in construction contracts.  This legislation would ensure that all construction-related businesses would not be held responsible for risk outside their control. 

Currently, Pennsylvania does not have an anti-indemnity statute regarding construction contracts. The result is the common practice of general contractors forcing subcontractors to except liability for the general's negligence. This legislation makes those types of indemnification provisions unenforceable.  

Forty-five states, including neighboring New York, Delaware, and Ohio have enacted anti-indemnity statutes that limit the enforceability of various forms of indemnity clauses in construction contracts.
