Potential Committee Vote: Vote NO on HB 5037
Lawmakers may soon hold a committee vote on HB 5037, a bill regulating how social media platforms operate in the name of protecting minors online.

Protecting children is a shared priority. But HB 5037 raises serious constitutional concerns and risks placing Connecticut on legally uncertain ground.

The bill regulates how platforms recommend and display lawful content, an area courts increasingly recognize as protected speech under the First Amendment. Similar laws in other states have already been blocked or struck down for restricting lawful expression and conflicting with federal law.

HB 5037 also imposes statewide default limits on notifications, usage time, and platform features unless parents opt out. Families have different values and expectations, and parents are best positioned to decide what is appropriate.

Legal challenges are likely, risking costly litigation and wasted state resources.
