  Election day volunteers needed  
 

ABC is asking for your help on Election Day 2022.  This year it falls on Tuesday, November 8th.  We are asking for members to offer at least 2 hours of assistance at a polling place near your company or home.  We are looking for volunteers in all 3 counties. 

Personal involvement goes a long way in cementing our relationships with statewide legislators.  We are putting together a list of volunteers and will be coordinating member efforts that day.  ABC will send you all the information and rules needed to participate at a polling place once you have registered.

  ABC to host Return Day event after Election day  
 

ABC Delaware will be hosting members at our Election Return day celebration on Thursday, November 10th.  Return Day is a traditional festival for the state of Delaware that is held on the Thursday after Election Day. It is used to celebrate the announcement of the election results in Georgetown, Delaware. 

ABC will be hosting members at our office on the circle in Georgetown where the parade ends.  We will be offering food and refreshments during the day and inviting legislators to join us.  CLICK HERE FOR FLYER.  To register, email ecapodanno@abcdelaware.com . There is no charge for members to attend.

The festivities start with a concert and a traditional free ox roast in the town circle. The festival events include food vendors, competitions, musical entertainment, arts and crafts, and a parade of the winning and losing candidates from both parties.

The candidates ride in horse pulled carriages or antique cars around the town circle, followed by the ceremonial "bury the hatchet" - where the Sussex County chairmen of the Democratic and Republican parties meet on stage, clutch the hatchet and together plunge it into a box of sand from Lewes - that signifies the end of the competition. The town crier reads the results of the statewide and Sussex County elections during the ceremony, and afterward, all attendees receive a free roast beef sandwich.

  ABC Participates in SBA Roundtable and Expresses Concerns About NLRB’s Joint Employer Proposal:  
 

On Oct. 20, ABC participated in the U.S. Small Business Administration’s Office of Advocacy virtual roundtable on the National Labor Relations Board joint employer proposed rule. ABC expressed disappointment that the NLRB is once again revising its standard for determining joint-employer status, which will cause great confusion among construction contractors, specifically small business owners. The new proposal will greatly expand joint-employer liability by trying to make indirect or even just reserved, unexercised control sufficient to trigger joint employer status. ABC plans to submit comments opposing the new proposal by the comment deadline of Dec. 7.

  DOL Extends Comment Period to December for Independent Contractor Proposal:  
 

On Oct. 25, the U.S. Department of Labor’s Wage and Hour Division announced it is extending the comment deadline on the ABC-opposed independent contractor proposed rule from Nov. 28 to Dec. 13 in order to allow sufficient time for parties to file initial comments. The decision comes after ABC urged DOL to extend the comment period by 60 days. ABC plans to submit comments opposing the new proposal, and members are encouraged to do so as well. 

DOL announced this new proposal to rescind and replace a commonsense, ABC-supported 2021 final rule on independent contractors on Oct. 11.   EEOC Releases FAQs on Updated 'Know Your Rights' Poster  
 

On Oct. 20, the U.S. Equal Employment Opportunity Commission released an update to the Oct. 19 version of its "Know Your Rights" poster, which replaces the previous "EEO Is the Law" poster.
