This is what Article V of the US Constitution says, “The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.”

It is only through God’s intervention that the 1787 Constitutional Convention produced the US Constitution! Did you know: The Articles of Confederation had specific guidelines (all states had to approve; remember Rhode Island did not even attend the convention!) for ratification to approve changes to it or to create a new constitution. The Constitutional Convention tossed those aside and made the process easier.
Some recognized the delegates had overstepped their original commissions: James Madison, in Federalist 40 – “it is therefore essential that such changes be instituted by some informal and unauthorized propositions . . . it is admitted that the convention have departed from the tenor of their commission.” -- points to the fact some recognized they were going beyond the authority in their commissions to the Constitutional Convention. Again . . . only God’s intervention during the 1787 Constitutional Convention produced the US Constitution.
The late US Supreme Court Justice Antonin Scalia: “A constitutional convention is a horrible idea. This is not a good century to write a constitution. Whoa! Who knows what would come out of it?”
Action Steps:
Currently, there are efforts in Harrisburg in both the State House and State Senate to pass resolutions calling on Congress to hold a constitutional convention (the proponents are calling it an Article V Convention of States – note, that language is not in Article V!). As we have seen through this ‘test’, there are no rules whatsoever for such a convention! Let your State Senator and State Rep know your thoughts on another constitutional convention.
