Alabama Secures Landmark Legal Victory as Lawsuit
Against VCAP Law is Dismissed
Birmingham, AL – Eagle Forum of Alabama (EFA) played a pivotal role in drafting and advocating for the Vulnerable Child Compassion and Protection Act (VCAP), a landmark piece of legislation passed in 2022 after three years of dedicated effort. This law aims to safeguard gender-confused minors from irreversible and harmful medical interventions.
“We are thrilled to share Alabama Attorney General Steve Marshall’s announcement of yesterday’s historic legal victory following the dismissal of the lawsuit challenging VCAP.” EFA President Eunie Smith continued, “The plaintiffs, represented by major national legal organizations, abandoned their challenge after Alabama’s investigation uncovered crucial evidence that the so-called “medical standards of care” were intentionally designed as a legal and political tool rather than a scientific guideline.”
Alabama’s investigation revealed that key medical organizations misled parents, promoted unproven treatments as settled science, and ignored growing international concerns over the use of sex-change procedures for minors. Internal communications uncovered by Alabama showed that the “standards of care” were crafted with input from lawyers and activists to win lawsuits and influence policy decisions—rather than being based on scientific evidence.
The VCAP Act, enacted in April 2022, prohibits experimental sex-change procedures for minors, including puberty blockers, cross-sex hormone treatments, and surgeries. The law was initially blocked by a federal district court but later reinstated by the U.S. Court of Appeals for the Eleventh Circuit in August 2023, allowing Alabama to enforce its protections for vulnerable children.
Apparently to cover up Alabama’s groundbreaking findings, the opposition chose to take Tennessee’s similar law to the U.S. Supreme Court rather than Alabama’s case—despite Alabama being first. This decision underscores the strength of Alabama’s legal position and the national impact of its work.
