New York State Governor Kathy Hochul and the New York State Department of Environmental Conservation (NYSDEC) have signed and adopted a statewide transition to ultra-low GWP (global warming potential) refrigerants. This means by 2034 that all virgin refrigerants MUST have a GWP of less than 10, leaving only ammonia, propane, isobutane, and carbon dioxide as usable virgin refrigerants. There has been a lawsuit filed against the NYSDEC for adopting this ultra-low GWP transition. You can view the lawsuit press release here.
In addition to fighting the NYSDEC regulation in the courtroom, there are solutions to stopping this infeasible HFC transition through legislation! Senator Gallivan and Assemblymember Conrad have filed S235 and AB3661. Each bill, respectively, would adopt the EPA federal HFC transition for New York and overrule the impractical ultra-low GWP transition being unilaterally forced upon the industry. We ask for your help to submit a comment letter asking your district's Assemblymember and Senator to co-sponsor and support each bill.
