The Bay Area Air Quality Management District (BAAQMD) has proposed a change to Rule 9-6. This change requires distributors in the Greater Bay Area to record and keep confidential business information available to BAAQMD whenever requested. The rule tries to help low-income families access non-compliant NOx water heaters. However, this amendment requires distributors to share customer lists, including prices of equipment sold, without clear limitations on how BAAQMD can use or share this data. 

Even if you do not sell water heaters, you should help stop the water heater's Rule 9-6 amendments. Stopping Rule 9-6 means stopping future invasive recordkeeping rulemaking, like the upcoming furnace Rule 9-4 amendments, from including similar recordkeeping requirements of customer lists and pricing. 

The BAAQMD Board of Directors will vote on this issue on November 4th. We must act now to prevent the disclosure of the distributor's confidential customer and pricing information. Take a few minutes to submit a comment to help protect your business and the industry.
