Tell Congress to Support the Fair and Open Competition Act
Ask your senators and representatives to cosponsor the Fair and Open Competition Act (H.R. 1209/S. 537). Introduced by Rep. James Comer (R-KY) and Sen. Todd Young (R-Ind.), this legislation protects federal and federally assisted construction contracts from government-mandated project labor agreements and will allow merit shop contractors to have a fair chance at construction projects. PLA mandates discourage experienced contractors from competing to win taxpayer-funded contracts to help rebuild America.

Policymakers in Washington must maintain a level playing field for taxpayer-funded construction contracts and encourage competition from all qualified companies, including small and minority-owned businesses. IEC is concerned with the Biden administration’s propensity to mandate PLAs on federal and federally assisted construction projects. IEC members deserve a fair chance to implement the $1.2 trillion Infrastructure Investment and Jobs Act and other legislation funding public works construction projects. Government-mandated PLAs will unnecessarily increase construction costs 12% to 20% and result in fewer infrastructure projects and jobs created by federal investment in America’s roads, bridges, schools and water and energy infrastructure.
