Under McFerran’s leadership, the NLRB has issued decisions and expanded interpretations of the National Labor Relations Act (NLRA) that have been rejected by the business community, Congress and federal courts. For example, she pursued implementation of a joint employer standard, which would have drastically altered existing contractor and subcontractor relationships, that was nullified by a U.S. District Court. 

McFerran has sought to implement union election policies that would drastically tilt the playing field in favor of Big Labor.
