Ask Congress to Support Fair and Open Competition
Ask your senators and representatives to cosponsor the Fair and Open Competition Act (H.R.2126 / S.1064), introduced by Rep. Clay Higgins (R-LA) and Sen. Todd Young (R-IN). This legislation ensures that federal and federally assisted construction contracts remain free from government-mandated project labor agreements (PLAs), giving merit shop contractors a fair opportunity to compete for taxpayer-funded projects.

Government-mandated PLAs limit competition, discourage experienced contractors, and drive up construction costs by 12% to 20%—reducing the number of infrastructure projects and jobs created. At a time when America is investing $1.2 trillion through the Infrastructure Investment and Jobs Act and other public works legislation, we cannot afford to waste resources or exclude qualified contractors.

IEC is particularly concerned about PLA mandates implemented by the Biden administration that are still in effect. These mandates threaten to shut out small, minority-owned businesses from participating in critical infrastructure projects.
