  ATTORNEY GENERAL DEALER RECOVERY FUND SIGNED INTO LAW  
 

During the Spring 2011 Legislative Session, the Illinois Attorney General introduced legislation to help consumers who are hurt by dealers who close their stores and fail to pay off trade in liens.  On August 22nd, Governor Quinn signed that legislation into law.

The legislation will create a 3-member board, composed of representatives from the Attorney General’s Office, the Illinois Secretary of State’s Office, and one person representing dealers. The Board will oversee a new Dealer Recovery Trust Fund, which will be created outside of the State treasury. 

Beginning October 1, 2011, the Dealer Recovery Trust Fund will add a $500 charge to the annual license fee for each new and used motor vehicle dealer and motorcycle dealers, plus $50 for each additional place of business.  Dealerships that sell 25 or fewer vehicles are exempt from this legislation. IADA estimates that the fund will collect approximately $2.0 million the first year.  Once the fund reaches a balance of $3.5 million, collection of the fee will be suspended the following year for any dealer who does not have a claim paid from the fund; have his or her license suspended or revoked; or have any civil penalties assessed against him or her during the previous 3 years.

The Attorney General's Office indicated that 48 states have some type of fund or bonding requirement to cover these situations. Their original proposal was a $1,000.00 fee per dealer or a bonding requirement that would have been even more expensive and permanent.

IADA is expected to administer the Fund to oversee that the funds are collected and used in accord with the provisions of the legislation.  One of the most important provisions included in the legislation was to structure the fund outside the State Treasury as an independent fund. An independent fund will not be available for the State to sweep for cash flow purposes!  Currently there is a lawsuit pending before the Illinois Supreme Court regarding this issue; however the fund involved in the lawsuit is considered a state fund!

  DEAC 2011 FUNDRAISING TO GET UNDERWAY  
 

Raising political funds for candidates at the state and national level is an important part of the political process and IADA continues to receive requests for campaign assistance from state and federal candidates.

This Bulletin article was prepared to help explain the difference between our state political action committee (IADA’s CAR of Illinois) and the national political action committee (NADA’s DEAC).  It is important to identify the PAC’s and support both to help insure the dealers’ voice is heard at the state and nation’s capitols.

CAR OF ILLINOIS (Committee of Automotive Retailers) - is IADA's state wide political action committee which only supports candidates running for the Illinois House of Representatives, Illinois Senate and state wide offices such as the Governor, Secretary of State and Attorney General.

Since CAR is a state wide political action committee it cannot support any candidates running for a federal political office. Corporate checks are acceptable and all CAR funds collected are spent on candidates with no administrative fees allocated to IADA.

IADA is the franchised dealer's voice in Springfield on legislative and regulatory matters, a strong state political action committee, (CAR) is necessary to promote IADA's legislative program on behalf of Illinois' franchised dealers.

DEAC (Dealers Election Action Committee)   is NADA's national political action committee and only supports candidates running for federal offices such as: United States Congress, United States Senate, etc.

DEAC is a national political action committee and may only contribute to federal candidates. Only personal checks are acceptable to federal political action committees and DEAC may not contribute to any state candidates.

NADA is the dealer voice on national legislative and regulatory matters and needs a strong national political action committee to further support for national issues affecting franchised dealers.

Each of these funds, CAR at the state level and DEAC at the federal level, plays an important role and is vitally important to promote dealer interest at both the state and national levels.

The important factor is dealers need to support both CAR and DEAC to assist their Associations' legislative efforts!

  NATIONAL LABOR RELATIONS BOARD REQUIRES EMPLOYERS TO POST EMPLOYEE RIGHTS  
  On August 25th, the National Labor Relations Board issued a final rule that will require employers to post a notice that informs employees of their rights under the National Labor Relations Act beginning November 9, 2011.  The required notice must be 11 x 17 inch and will be provided by the National Labor Relations Board by November 1, 2011.  Failure to post the notice will be considered a violation of the National Labor Relations Act and is likely to extend the period during which an employee can file an unfair labor practice charge.  Additional information can be found on the NLRB’s website at: https://www.nlrb.gov/node/1526.
