IMPORTANT INFORMATION FOR SAAB DEALERS

Now that Saab has announced that it will suspend payment of warranty and incentive claims, Saab dealers will have to decide whether to perform service that would have been covered by Saab’s warranty free of charge to the customer. Unlike General Motors and Chrysler, which were reorganized under the Bankruptcy Code, there is no guarantee that Saab will be similarly reorganized. It is possible that there will not be additional funds to reimburse dealers for future “warranty” work.
Saab vehicles that are still within their warranty periods can be divided into 3 classes:
• Vehicles that were sold while Saab was owned and controlled by General Motors;
• Vehicles that were sold after General Motors sold its controlling interest in Saab; and
• Vehicles that have not been sold.
General Motors has indicated that it will pay warranty claims on vehicles that were sold while Saab was under its control. GM sold its controlling interest in Saab in February, 2010. Dealers should expect to be reimbursed for warranty work done on vehicles sold before GM gave up its controlling interest in Saab.
Vehicles sold after GM gave up its controlling interest are a more difficult matter. Dealers may not be reimbursed for any “warranty” work performed on post-GM era Saab vehicles. Saab dealers will have to decide whether they are willing to repair vehicles sold after February, 2010 as a matter of good will. A customer seeking warranty repairs who bought a vehicle from your dealership might argue that the implied warranty of merchantability makes you responsible for repair costs.
Saab has announced that new vehicles that are still in inventory should be sold “AS IS”. Under Illinois law, selling the vehicles “AS IS” will disclaim any implied warranty of merchantability. If you sell new Saab vehicles “AS IS”, you should remove all warranty materials from the vehicle. You may consider explaining to customers that Saab is no longer in business and those future parts availability could become problematic.

Saab Cars North America, the U.S. sales and distribution unit of Swedish car maker Saab Automobile AB, said today it has named an outside administrator to run the company as part of a plan to avoid immediate liquidation following its parent company’s bankruptcy filing Monday.
During a telephone conference with reporters, the U.S. operation’s chief operating officer Tim Colbeck said the outside firm, McTevia & Associates, will attempt to resume the unit’s operations including warranty work and business with dealers that essentially stopped with the bankruptcy filing.
“We’ve basically stopped our business in an effort to not incur any additional debt,” Colbeck said.
He said the U.S. Saab operation is also trying to reestablish business with its parts supplier in Sweden, which is a separate company that is not in bankruptcy. The overall plan, he said, is to “keep this brand going.” However, Colbeck acknowledged that the outlook right is not good. Creditors could still force Saab North America into bankruptcy and liquidation, he said. The U.S. unit could also seek court protection in the future, though it has made a point so far of keeping the procedures out of court, Colbeck said.

COOK COUNTY SALES TAX INCREASES EFFECTIVE JANUARY 1ST
|

|
Beginning on January 1, 2012, the Cook County Use Tax on Titled Personal Property will increase from 0.75% to 1%. This tax increase does apply to motor vehicles that will be titled and registered in Cook County and must be collected by dealers in Cook County and may be collected by dealers in other counties who have signed up with Cook County to collect the tax. BAN ON CELL PHONE USE IN VEHICLES PROPOSED
|
|
|
The National Traffic Safety Board (NTSB) called this week for a nationwide ban on the use of all cell phones and other electronic devices by all drivers. The sweeping proposal goes far beyond what any state currently prohibits. And it could force automakers to make major changes to in-vehicle technology systems that now allow drivers to link cell phones to their vehicles. The safety board, which makes nonbinding recommendations, wants states to ban all cell phone use – hands-free or hand-held – behind the wheel.

IRS ANNOUNCES 2012 STANDARD MILEAGE RATES
|
|
|
The Internal Revenue Service (IRS) this week announced the 2012 optional standard mileage rates used to calculate the deductible costs of using a vehicle for business, charitable, medical or moving purposes.
Beginning Jan. 1, the standard mileage rates will be 55.5 cents per mile for business use, 23 cents per mile for medical or moving purposes, and 14 cents per mile in service of charities. The rate for business miles is unchanged from a mid-year adjustment that became effective on July 1, 2011. The medical and moving rate has been reduced by 0.5 cents per mile.
The standard mileage rate for business is based on an annual study of the fixed and variable costs of operating a car. The IRS reminds taxpayers that they always have the option of calculating the actual costs of using their vehicle rather than using the standard mileage rates.
