  NADA NAMES NEW PRESIDENT  
 
Peter Welch has been selected President of the National Automobile Dealers Association effective February 1.
 
Welch has been president and chief executive officer of the California New Car Dealers Association in Sacramento since 2003, and has managed its government affairs office, including legal, legislative and regulatory affairs, since 1990. 
 
"Peter has successfully representing dealers for over 20 years in California, which is reputably one of the most difficult states for dealers from a regulatory and legal standpoint.  “I have known Peter for many years and have worked with him in our ATAE organization and believe that NADA has made a great selection for him to represent dealers nationwide,” said IADA President Pete Sander.

  CHICAGO AUTO SHOW 2013  
 
The Chicago Auto Show will be held at McCormick Place on February 9-17, 10am-10pm, and February 18th, 10am-8pm. The First Look for Charity Event will be held on February 8th.

  LEGAL REMINDER: FREE GIFT RULE  
 
The Attorney General’s Office has informed IADA that it has found several violations of its free gift rule related to dealer offers of “free warranties”.  Generally, the free warranties are actually extended service contracts that a dealer purchases from a third party and provides to vehicle customers at no cost.  Dealers cannot advertise or offer free gifts, including free warranties or free extended service contracts, under the Attorney General’s free gift rule.  The free gift rule can be found at: http://www.ilga.gov/commission/jcar/admincode/014/014004750D05900R.html.

  YOUR BANK ACCOUNT MAY NO LONGER BE FULLY INSURED  
 
From December 31, 2010 through December 31, 2012, the FDIC provided unlimited deposit insurance coverage on all noninterest-bearing accounts in FDIC insured institutions, but that coverage ended effective January 1, 2013. Now, the maximum amount of coverage provided is $250,000.
 
For example, prior to January 1 a business with a $750,000 balance in a noninterest-bearing bank account enjoyed FDIC insurance coverage on the entire amount in the event the bank failed. Beginning January 1, 2013, that same account would be insured for only $250,000 whether it was in an interest-bearing or non-interest bearing account.   CONGRESS REPEALS INSURANCE BOOKLET MANDATE FOR DEALERS  
  On January 10, 2013, President Obama signed into law H.R. 5859, which eliminates the mandate that requires new-car dealerships to keep an obsolete insurance booklet on hand or face a fine. The legislation, endorsed by NADA, passed the House in late July and the U.S. Senate approved the bipartisan bill on December 21, 2012. In a survey of 815 of its members, NADA found that 96 percent of dealers reported that none of their customers had ever asked to see the booklet. In a 2011 directive to Congress on a highway and vehicle safety bill, the Obama administration said the data in booklet is “rarely used and not useful.” The administration also stated “a prospective buyer does not need a brochure from the federal government to obtain this information, since insurance agents are trained to provide advice on how model selection affects insurance premiums.” Under a 1972 law, the National Highway Traffic Safety Administration prepares, prints and mails the booklet, Relative Collision Insurance Cost Information, to new-car dealerships annually. Dealers were required to provide it to their customers upon request or face a $1,000 per violation fine. The bill, H.R. 5859, does not eliminate the government’s ability to make the insurance data available online or by other means.

  LEGAL REMINDER: FRANCHISE ACT REQUIRES EQUITABLE ALLOCATION OF NEW VEHICLE INVENTORY  
  A January 14th Automotive News article reported that Chevrolet will make the redesigned 2014 Corvette available only to dealers who sold at least 4 Corvettes last year.  Section 4(d) of the Motor Vehicle Franchise Act requires manufacturers to deliver reasonable quantities of vehicle inventory covered by a dealer’s franchise agreement to the dealer within a reasonable time after receipt of the dealer’s order.  Section 4(d) also prohibits a manufacturer from engaging in arbitrary or capricious allocation of vehicle inventory to dealers.  Any dealer who is unable to obtain requested new vehicle inventory may want to consider consulting his or her legal counsel about responding to possible violations of the Motor Vehicle Franchise Act.  If you have any questions about this article, please contact IADA Legal Counsel at (217) 753-0220 or ldoll@illinoisdealers.com.

  TIER II REPORTING FOR DEALERSHIPS  
  Do you store chemicals at your facility?  Chances are high the answer is “Yes.”  As a business that stores and uses chemicals you have certain regulatory obligations to your employees, your community, and to emergency responders in your area.  A March 1st deadline is fast approaching for one of those obligations:  Tier II reporting under the Emergency Planning and Community Right-to-Know Act (EPCRA). This article will cover the information you need to know in order to comply.
