  LEASE TAX BILL (HB 2317) UPDATE  
 
HOUSE BILL 2317 (HB2317 Fact Sheet) which changes the tax base for motor vehicle leases from the selling price of the leased vehicle to the amount of the lease payments, failed to be called for a vote in the Illinois House on the last day of the legislative spring session!  This legislation passed out of the Senate 55-0, a day earlier. While we were disappointed HB 2317 did not get called for a vote, we feel optimistic this legislation could be considered in the fall veto session.
 
IADA has already discussed with the House Speaker’s Chief of Staff regarding consideration in the fall veto session, and will continue to work with the House Legislative Issues Staff who had concerns with the financial impact of the legislation. 
 
During the summer months we ask dealers if you have the opportunity to visit with a House member ask that they favorably consider this legislation during the veto session!  IADA will keep everyone up to date as we continue to work on this legislation.

  GUIDANCE/MODEL FORMS ISSUED FOR REQUIRED HEALTH CARE REFORM LAW NOTICES  
 
The U.S. Department of Labor (DOL) on May 8 provided “temporary guidance” regarding the written notice employers are required to provide to their employees under the Patient Protection and Affordable Care Act (PPACA). PPACA requires that applicable employers must provide each employee with a written notice providing the employee with information about the state and federally-facilitated health insurance exchanges and how to request assistance, describing the availability of a premium tax credit (if applicable) and outlining the implications for the employee if they choose to purchase a qualified health plan through an exchange. The notice requirement was originally scheduled to take effect on March 1, 2013, but subsequent guidance has indicated that the timing for distribution of notices will be the late summer or fall of 2013 in coordination with the open enrollment period for exchanges. 
 
Along with technical release, the following model notices have also been issued by the DOL:

Dealers should consult their health care consultant, insurance carrier or other outside professional to determine which form is appropriate for your dealership, and how to properly complete and distribute that form to your employees.   NADA LOSES RISK BASED PRICING LAWSUIT  
 
NADA, which sued the FTC challenging its interpretation of a federal disclosure law, has lost in Washington D.C. District Court and now also in Appeals Court. 
 
The lawsuit was based on this question: If a dealer successfully arranges installment financing for a customer, but never pulls a consumer credit report, is the dealer nonetheless required to provide the customer a "Risk Based Pricing" credit score disclosure?
 
The answer hinges on the legal interpretation of the word "used."
 
The FTC issued a written interpretation that, in the typical installment sales transaction, the disclosure obligation was triggered even if the dealer never obtained a consumer credit report, because the dealer has "used a credit report in connection with an application for credit because [the dealer] initiated the request that caused the financing source to obtain the consumer report..."
 
In 2011, NADA challenged the FTC's interpretation in Federal Court, arguing that a dealer can't be considered to be "using" a credit report that it never sees. NADA also questioned the feasibility of a dealer obtaining credit score information from a lender.
 
This final ruling means that dealers will be required to generate a credit score disclosure for all consumer customers approved for and offered vehicle financing. That may mean dealers pulling a bureau when they otherwise would not - possibly to the detriment of their customer's credit rating. 
 
For many dealers who always obtain consumer credit reports on their finance customers, this ruling has no real effect, as they already use outside vendors to routinely generate a credit score disclosure.
