  IMPORTANT MESSAGE FROM THE ILLINOIS DEPARTMENT OF REVENUE  
 
Did you know you can file your ST-556 Sales Tax Transaction Returns for FREE using the Illinois Department of Revenue’s  MyTax Illinois program at tax.illinois.gov? MyTax Illinois is an online account management program that provides a centralized location for taxpayers to register a new business, file returns, make payments and manage their tax accounts.
 
We encourage you to use this system, or file electronically through approved third party software providers such as CVR. If you haven’t yet made the transition to electronic filing, you should be aware that beginning Oct. 1, 2013, the old three-part pin-fed ST-556 forms will no longer be available. Those forms use a very old technology and IDOR is no longer able to repair the equipment. Form ST-556-WS is available in the FORMS section of our web site at tax.illinois.gov for your use in preparing for your electronic filing session and to obtain a customer signature for your records.
 
If you absolutely must file paper returns, a single-page form will be available, but you will need to make copies for your customer and for your own records. The blank form will not be able to be reproduced, as it contains a unique identifier for each transaction.
 
A letter and informational bulletin with more details will be arriving in your mailbox soon. So, help us go green and file on line at tax.illinois.gov.

  EPA PROVISIONALLY EXCLUDES SOLVENT WIPES FROM HAZARDOUS WASTE RULES  
 
Yesterday, EPA issued a rule conditionally excluding solvent-contaminated wipes from its hazardous waste regulations, provided dealerships manage them properly. 
 
The wipes used in dealership service and autobody operations run the gamut from woven laundered cloths to paper disposable wipes, wipers, shop towels and/or rags. Some are used with solvents, others to wipe up liquids such as oils, greases, paints and antifreeze.

Generally, wastes contaminated with EPA-listed solvents become “hazardous” and must be managed as such. Under the new rule, used wipes contaminated with EPA-listed solvents are not “hazardous” waste if they are: 
 
1. Stored in closed, labeled containers.
2. Liquid-free when sent off-site for cleaning or disposal. 
3. Not accumulated for longer than 180 days.
 
Service and body department wipes are used with numerous liquids and for various purposes, and are often intermixed prior to off-site cleaning or disposal. Consequently, dealerships should consider implementing the above three management strategies for all used wipes. 
 
The push to obtain regulatory relief for rags and wipes began in 1992. Through the years, NADA filed several sets of comments, formally participated on a Small Business Regulatory Enforcement Fairness Act panel, and met numerous times with EPA. The protracted deliberations leading up to yesterday’s final rule largely can be attributed to a competitive battle between disposable wipe manufacturers, their reusable wipe counterparts, and commercial laundries.

  KPA: OSHA CRACKS DOWN ON HEAT STRESS  
 
Although workplace heat stress has no specific standard in most states, OSHA has begun to aggressively inspect for heat-related issues. This is especially true in states like CA where specific regulations exist.  Employers need to plan now to protect their employees from heat stress as well as protect themselves from costly citations and litigatio
 
Too much heat can compromise a body’s cooling system, resulting in dehydration, cramps, exhaustion, and in some cases, fatal heat stroke. The risk of heat stress varies from person to person, which makes the challenge of a safe work place even more challenging. Factors include physical condition, temperature, humidity, clothing, pace of work, and environmental conditions. Heat stress is particularly prevalent in auto shops that do not have air conditioning.
 
OSHA is urging employers to create a heat stress program. Utilizing OSHA’s General Duty Clause, Section 5(a)(1), the agency is attempting to regulate activities surrounding the risk of heat stress. A violation of the General Duty Clause may occur when workers have been working in hot environments and employers are aware of the risks but have not taken adequate protective action.
 
To protect your employees, implement the following:
 
Provide adequate water, rest, and shade.
Acclimate new employees and current employees who are returning from an extended time away.
Implement a work and rest schedule.
Provide a climate controlled area for cool down.
Train temporary employees on the risk of heat stress and acclimate them to the environment.
 
In the event that heat stress does occur, OSHA may cite an employer if prompt remedial action is not taken when an employee falls ill. To protect your employees and yourself, establish specific responses and procedures for heat related emergencies. Training on the signs and symptoms are also encouraged.
