  LEASE TAX BILL (HB 2317) UPDATE  
 
As we approach the fall veto session, IADA asks for your continued support regarding HOUSE BILL 2317. 
 
HB 2317 which changes the tax base for motor vehicle leases from the selling price of the leased vehicle to the amount of the lease payments, failed to be called for a vote in the Illinois House on the last day of the legislative spring session!  This legislation passed out of the Senate 55-0, a day earlier. While we were disappointed HB 2317 did not get called for a vote, we are optimistic this legislation will be considered in the fall veto session.
 
IADA has had discussions with the House Speaker’s Staff regarding consideration in the fall veto session.  We are continuing to work with the House Legislative Issues Staff who had some initial concerns with the financial impact of the legislation. This legislation is one vote away from going to the Governor’s desk. We ask dealers to contact House members for their support on House Bill 2317 prior to the fall veto session, October 22-24 and November 5-7. IADA will continue to keep everyone up to date as we continue to work on this legislation.

  NADA WASHINGTON CONFERENCE  
 
NADA hosted its annual Legislative Conference with close to 400 dealers from across the country attending to be updated on legislation and various regulations along with meeting with their Members of Congress.
 
Illinois Dealers attending the NADA Washington Conference included IADA Chairman Gary Knight, Carmack Car Capitol, Danville; IADA Vice Chairman Mike Mangold, Mangold Ford, Eureka; NADA Director Jamie Auffenberg Jr., St. Clair Auto Mall, O’Fallon; and IADA Legislative Affairs Director Joe McMahon.  Attending from CATA were CATA Chairman John Webb, Packey Webb Ford, Wheaton; CATA Directors John Alfirevich, Apple Chevrolet, Tinley Park; Ray Scarpelli, Jr., Ray Chevrolet, Fox Lake; NADA Directors Desmond Roberts, Advantage Chevrolet, Bolingbrook; Mark Scarpelli, Raymond Chevrolet, Antioch, and CATA President Dave Sloan.
 
IADA and our CATA counterparts hosted a Reception of the Illinois Republican Delegation at the Capitol hill Club and held meetings with several Democratic Congressmen.

Dealers met with their members of Congress to discuss the Consumer Protection Finance Bureau’s regulations regarding assisted automobile financing, Estate Tax Reform, preserving the LIFO accounting method, and concerns with dealer rental vehicles under an open recall situation.  Our appreciation to our Illinois dealers’ for representing our membership in our nation’s capitol!

  NADA Update (Fall 2013) Jamie Auffenberg Jr., St.Clair Auto Mall, O'Fallon, IL

The FTC issued a press release Sept. 3 stating that it has entered into proposed consent orders with a Cleveland dealership and a Baltimore area dealership for alleged advertising violations that appeared on their respective websites. In the former case, the FTC alleged that the dealer advertised that particular Ford models are available at a specific dealer discount when “in fact, once consumers reach the dealership, they find out that [the dealership] has failed to disclose that the specific discounts are available for some, but not all, of the Ford models advertised.”  
 
In the latter case, the FTC alleged that the dealer advertised specific dealer discounts and prices as being generally available to consumers when “in fact, once consumers reach the dealership, they find out that there are significant restrictions on obtaining the advertised discounts or that the advertised discounts are not available in full.” In particular, the FTC alleged: “In numerous instances, the advertised discount and price are subject to various qualifications and restrictions … for example, being a member of the military, being a recent college graduate, possessing a bank account at a particular bank, or owning a vehicle that has a lien on it. In numerous instances, even if consumers meet all of these qualifications or restrictions, they cannot obtain the advertised discount and price.”
 
The FTC alleged that these are deceptive practices which violate Section 5 of the FTC Act. In the proposed consent orders, the dealerships (which neither admit nor deny the alleged violations) agree to several provisions such as avoiding certain advertising representations, retaining their ads and promotional material for 5 years, and filing compliance reports with the FTC.

  KPA: WHAT DO YOU NEED TO KNOW ABOUT THE CHANGE IN THE HAZCOM REGULATION?  
 
Employers are responsible for implementing the changes in the Hazard Communication regulation at their dealership. So, as an employer, what do you need to know about the Hazard Communication changes?
 
1. Hazards must now be classified, noting the hazard class and hazard category. This will define the level of hazard and the degree of severity.
 
2. Percentages for classifying mixtures now have a tiered approach, instead of broad definitions.
 
3. The new standard requires specific and information and language on labels. Harmonized signal words, pictograms, and hazard statements must be used. Additionally, statements listing precautionary hazard measures must be listed.
 
4. 16-section safety data sheets (SDS) are now required to provide consistent information.
 
5. OSHA’s mandatory permissible exposure limits (PELs) and the non-mandatory threshold limit values (TLVs) must be listed on the SDS.
 
6. Employers are required to train employees on the new label elements.
 
7. Employees must be trained on the new standard by December 1, 2013. Compliance with the modified provision of the final rule must be met by June 1, 2016.
 
8. Distributors may ship products labeled under the old HazCom standard until Dec. 1, 2015.
 
9. Employers must update workplace labeling and written hazard communications by June 1, 2016.
