HOUSE PASSES NADA-BACKED LEGISLATION TO REPEAL OUTDATED PAPERWORK MANDATE

January 8th - the U.S. House of Representatives passed, by a vote of 405-0, an NADA-backed bill to repeal an unnecessary paperwork burden on small business automobile dealerships. The bill, H.R. 724, eliminates an outdated federal mandate requiring auto dealers to certify that new vehicles are Clean Air Act compliant. The legislation was introduced by U.S. Reps. Bob Latta (R-Ohio) and Gary Peters (D-Mich.), and has 105 bipartisan cosponsors. The bill now moves to the U.S. Senate for consideration.
Since 1981, franchised automobile dealers who sell a new vehicle have been required to provide purchasers with a government form that states the vehicle conforms to the Clean Air Act, even though all new cars and trucks must comply with the Clean Air Act before leaving the factory. H.R. 724 repeals this redundant mandate.
New-car and -truck buyers can still find documentation of a vehicle's Clean Air Act compliance under the hood of the vehicle, on the Internet, or in the owner's manual and supplements.

REMINDER - NEW SOS ENFORCEMENT OF DELINQUENT TITLE APPLICATIONS

IADA To Send Notices To Assist Dealers When CVR Inventory POs Placed
As IADA has previously reported, beginning January 1, 2014, the IL SOS has made revisions to the enforcement of vehicle registration paper work requirements. The Illinois Vehicle Code has always required dealers to provide certificates of title to SOS within 20 days after the date of sale, and any violation of this practice could be enforced as a criminal offense with possible penalties of dealer license forfeiture. The new revision gives the SOS the discretion to impose an administrative fee instead of pursuing a criminal penalty; however, SOS will begin issuing delinquent fees for late paperwork.
Public Act 98-177 makes the following changes to Section 3-113 of the Vehicle Code:
Allows the Secretary of State to impose a delinquent vehicle dealer transfer fee on vehicle dealers if the certificate of title is received by the Secretary from the dealer 30 days or more after the date of sale. The amount of the fee is $20 if received 30 days but less than 60 days after the sale, $35 if received 60 days but less than 90 days after the sale, $65 if received 90 days but less than 120 days after the sale, and $100 if received 120 days or more after the sale. Allows a Secretary of State Police investigator to issue administrative citations to new or used vehicle dealers, or any other entity licensed by the Secretary under the Illinois Vehicle Code, for violations of any provision of the Illinois Vehicle Code or violations of any administrative rule adopted by the Secretary under the Illinois Vehicle Code. Effective January 1, 2014.
Any SOS delinquent fees will be administered directly from SOS and will apply to all dealers regardless of whether they process title work manually or electronically, or use a 3rd party vendor such as CVR or the state's PERT program.
In an effort to assist dealers and help avoid these late fees, IADA will send notices and hold inventory purchase orders for dealers who have delinquent pending deals over a certain threshold. If not already in place, dealerships should have internal policies to insure title applications are completed in a timely manner. |

THE GHS DEADLINE HAS PASSED. WHAT NOW?

OSHA required all employees to be trained on the new label elements and safety data sheet (SDS) format of the Globally Harmonized System (GHS) by December 1, 2013.
There will be additional requirements over the next two years as the revised Hazard Communication Standard (HCS) is fully implemented.
June 1, 2015 Chemical manufacturers, importers, distributors, and employers must be in compliance with all modified provisions of the final revised HCS, with the exception of shipping container labels.
December 1, 2015 Chemical manufacturers, importers, distributors may only ship containers labeled with a GHS label.
June 1, 2016 Employers must update their alternative workplace labeling. Hazard communication programs must be updated (as necessary) and employees must be provided with any additional employee training for new physical or health hazards.
