SUNDAY CLOSING LAW (SB 2629) UPDATE
|
|
|
Senator Jim Oberweis (Republican) has introduced a bill to repeal the Illinois' Sunday Closing Law for vehicle dealerships. The hearings will be starting soon. We ask that you reach out to your State Senator for a commitment to vote against the repeal. Ask your Senator to vote against SB 2629. For the easiest way to contact your respective elected officials, use our simple IADA-Grassroots Action Center, click here. An IADA Fact Sheet is available here.
In 1982, The Illinois Legislature enacted legislation to close dealerships on Sunday - this law was appealed to the Illinois Supreme Court. The Supreme Court upheld the law, indicating that the Sunday Closing Law was "part of the regulatory scheme" that regulates auto dealerships differently from other businesses.
IADA will continue to keep everyone up to date as we continue to work on this issue. |

FEDERAL TRADE COMMISSION CRACKS DOWN ON DECEPTIVE ADVERTISING
|
|
|
Motor Vehicle Dealers have another traffic cop to worry about in addition to the Attorney General's Office when it comes to advertising violations. The Federal Trade Commission recently brought deceptive advertising claims against 10 motor vehicle dealers as part of a nationwide investigation of motor vehicle dealer advertising. The FTC and 9 of the dealers have settled the charges and are in the process of entering into a consent order to memorialize the settlement. The FTC is pursuing the charges against the 10th dealer. The FTC's charges alleged that:
- Two dealers advertised a low monthly payment that was actually a teaser rate that increased after a few months.
- Three dealers advertised a $0 upfront lease payment when, in fact, substantial fees and other charges were due at signing.
- One dealer sent sweepstakes-style mailers claiming that the recipients had won prizes when no prizes were awarded.
- One dealer advertised a purchase price with low monthly payments and failed to advertise a $10,000 balloon payment at the end of the term.
- One dealer advertised a low up-front payment and low monthly payments when the up-front amount was actually significantly higher. The FTC also alleges that this dealer failed to disclose that its offer was a lease.
- One dealer advertised prices that were $5,000 lower than the actual price.
The FTC has indicated that it is likely to bring additional actions against dealers.
The Attorney General's and the FTC's Motor Vehicle Advertising Rules and Related Statues can be found in the FAQ section at www.illinoisdealers.com. If you have any motor vehicle advertising questions, please feel free to contact IADA at (217) 753-0220. |

This is a great opportunity for members to save on your operating costs. Please call Brian Hirshberg at (812) 431-4509 to complete a savings analysis, discuss this opportunity, or ask any questions that you may have. |
